Terms and Conditions

Thank you for considering working with Forest Moon Sleep.

Please read these terms and conditions prior to a purchase of a consultation or guide.

If seeking a consultation with Forest Moon Sleep, please indicate that you have read and accepted them on the sleep questionnaire/diary which has been sent to you. For services that do not require a questionnaire/diary, your acceptance of these terms and conditions will be deemed upon booking.

1. Disclaimer

By deciding to seek support from Forest Moon Sleep, you understand that the service I provide is not a substitute for medical, nutritional, lactation, psychological, therapeutic care, and it is also not a substitute for counselling, diagnosis, treatment or any type of medical care. Please consult your GP/doctor or other suitably qualified professional if you have any concerns regarding your child’s (or your own) health or well-being. Any information I give around feeding or nutrition is also for information purposes only and should not replace professional lactation or dietary support.

 

2. Scope of Practice

By choosing to work with Forest Moon Sleep, you understand that I will not tell you what to do, but will work with you to find a solution that is sustainable for your family. I will make suggestions and provide education and information based on my training and experience. You are responsible for whether you choose to implement any suggestions offered.

 

By working with me as a sleep consultant, you agree that you are consulting with me in relation to sleep alone. Any other queries or concerns can be addressed either separately, or by an alternate practitioner. In particular, by choosing to work with me, you agree that:

 

  1. You will work within safe sleep guidelines

  2. You will disclose any relevant medical problem/issue in relation to you and your little one.

  3. You understand that if I am concerned for the welfare of your child, I have a duty to report this to the relevant health and/or safeguarding service in your local area. This will always be with your knowledge except in cases where the immediate safety of the child takes priority

  4. You understand that you will be providing certain personal details which are required to be kept. Information will never be shared with any other third party unless otherwise agreed for individual reasons. 

  5. Invoices are payable immediately upon receipt.

  6. Your booking will not be fixed until payment is received and no work will commence, including pre-analysis of sleep questionnaire/diary, until payment is made in full. If no payment is made by 72 hours prior to the agreed consultation/service date I reserve the right to rearrange to allow time for my pre-consultation analysis and planning.  Troubleshooting calls also require payment in accordance with this paragraph.

  7. Your sleep support is bespoke to you, and should not be shared with or relied upon by other third parties, as the information may not be relevant.

  8. In the case of a troubleshooting call, this is not a substitute for a fully comprehensive sleep package. I will do my best to brainstorm your concerns with you but I will not be analysing a full sleep diary and questionnaire or providing detailed recommendations. Further support may be required, depending on the individual situation.

 

3. Availability

I will provide support as set out in the specific sleep package you have purchased (please see the details set out on my website). Where applicable/set out in your purchased package, I will send a written summary of the consultation, with suggestions discussed in the consultation as soon as possible. A follow-up email will be provided with the full consultation package. If you wish to receive additional email correspondence, I will discuss with you purchasing additional follow up as required.

 

I currently generally work on Mondays, Tuesdays and Thursdays between the hours of 9am and 12pm (but this may be subject to change). Any contact on my non-working days will be answered on my next working day, or at my earliest availability.

 

I work internationally, and reside in the UK, on GMT or British Summer Time (GMT+1). I will endeavour to be flexible for international clients, where possible.

 

If you do not answer calls or emails, or initiate contact, then it will be assumed that you no longer need or want sleep support.

 

4. Guarantees

I cannot and do not guarantee a particular result (such as your little one sleeping through the night), or a particular timeframe within which you will see results. This is due to the fact of every child and set of circumstances being unique and there are too many variables to guarantee a specific outcome.

 

I will, however, use my efforts to support you and your child to improve their sleep situation. I will never use (or suggest that you use) cry-it-out, Ferber, or any other method that will require you to leave your child alone to cry. I will only recommend responsive strategies.

 

5. Equality and non-discriminatory practice

I promote an inclusive, non-judgemental service, and will not knowingly discriminate against anyone on the basis of their race, sexual orientation, parenting style, disability, cultural beliefs, marital status or religion. If there is anything you would like me to be aware of, please make this clear at the beginning of the consultation.

 

6. Pricing and payments

I may change my prices from time to time. Changes in price will not affect any purchases already made, but will apply to any subsequent purchases.

 

Payments need to be made in full at least 72 hours prior to the consultation date, unless otherwise agreed with me.

 

Promotions and discount codes are valid on the specified support packages only, and for the specified time only.

 

7. Cancellation/refund policy

It is your parental right to cancel at any time if you do not feel that sleep coaching is right for you or your child. I may ask why you have chosen to cancel in order to improve my services going forward, however you are under no obligation to give any reasons if you do not wish to do so.

 

For cancellations made by you more than 72 hours before the consultation/service date, or for rescheduled appointments due to illness / exceptional circumstances (at my discretion), there will be no charge. Appointments can only be rescheduled once without charge. If you do need to reschedule again, a £10 admin fee will be required prior to re-booking.

 

For cancellations made by you between 48 and 72 hours prior to the appointment, a 50% refund will be issued.

 

For cancellations made by you between 24 and 48 hours prior to the appointment, a 25% refund will be issued.

 

Please note that cancellations within 24hrs of your appointment will not be refunded, and I am unable to refund any missed appointments.

 

I reserve the right to cancel or rearrange your consultation if I have not received your completed documents by 72 hours before the consultation.

 

If I have to cancel our appointment for any reason then I can do so without notice (though I will, of course, aim to give you sufficient notice) and I will offer an alternative appointment time at no extra cost to you, at a mutually convenient time.

 

If, after reading your sleep questionnaire/diary, I feel that a different approach or alternative support would be more appropriate in the circumstances, then I will issue a partial or full refund (at my discretion), regardless of how soon the appointment is.

 

8. Purchasing e-guides / courses

Due to the nature of a digital sale, all sales are final. Once you have access to any digital content purchased, you no longer have the right to cancel that purchase or claim a refund, as the product is unable to be returned.

 

9. Changes to terms and conditions

I may need to change my terms and conditions from time to time. If this is the case and you have an active support package, I will inform you of the changes and the reason behind them as soon as possible. I will provide you with the option of a full refund if you are no longer wanting sleep support as a result of these changes.

 

10. Applicable law

All agreements between Forest Moon Sleep and its clients, including these Terms and Conditions, as well as any dispute relating to the services of Forest Moon Sleep, are governed exclusively by the law of England and Wales and subject to the jurisdiction of the English Courts.

 

11. Indemnity

By agreeing to these Terms and Conditions, you fully indemnify Forest Moon Sleep against any liability that may arise as a direct or indirect consequence of your failure to comply with these Terms and Conditions.

 

12. Force majeure

The performance by Forest Moon Sleep of its obligations under these Terms and Conditions may be suspended in the event of force majeure. Force majeure occurs when an event beyond the control of Forest Moon Sleep, which was not reasonably foreseeable when the Terms and Conditions have been declared applicable, and the consequences of which cannot be avoided by appropriate measures, prevents either party from fulfilling their obligations.

 

13. Other

If at any time a provision of these Terms and Conditions is invalid or unenforceable, the validity and enforceability of the other provisions of these Terms and Conditions will not be affected. A provision that is not legally valid or enforceable is also deemed to have been replaced by a provision with a content and scope that approximates the original provision as closely as possible and that is legally valid and enforceable.

 

14. Comments, compliments and complaints

I seek to provide a high level of service via my support packages. If you have enjoyed working with me and would like to provide positive feedback or compliments after working with me, I would be extremely grateful. You can do this either directly via email or via the contact form on my website. If I wish to share any of this feedback either on my website or social media as a testimonial I will ask your permission first, and also completely anonymise it if you would like me to.

 

I hope that you will be completely happy with the support you receive from me, however if you are unsatisfied with my support for any reason, please contact me in the first instance so that we can try to reach a friendly resolution.

 

15. Confidentiality

I try to limit collection of personal data but there is some necessary information gathering involved in working together. Any personal data or information will be kept completely confidential.

 

16. Personal data

I will delete your personal data once the purpose for which it was collected is fulfilled, unless you indicate you may wish to purchase further services in the future, in which case I will retain your data for a further 5 years.
